1. About Us
Mirissa Collective is a trading name of TP Development PvT Ltd, a company registered in Sri Lanka. TP Development PvT Ltd operates diving, snorkeling, whale watching, kayak, and fishing activities in Mirissa and Nilaveli, Sri Lanka. By booking an activity through our website, you enter into an agreement with TP Development PvT Ltd.

2. Bookings and Payment
When you complete a booking on our website, you enter into a binding agreement with TP Development PvT Ltd (trading as Mirissa Collective). All payments are processed in USD via PayHere, our secure payment gateway.
Standard activities (diving, snorkeling, whale watching, kayak, fishing): Full payment is required at the time of booking.
PADI courses (Open Water Diver, Advanced Open Water Diver, Scuba Diver): A 50% deposit is charged at the time of booking. The remaining 50% is due on Day 1 of your course at the dive center — payable in USD cash, Sri Lanka Rupees, by card, or via a payment link.
Your booking is confirmed once payment is successfully processed and you receive a confirmation email.
3. Medical Requirements
Diving, snorkeling, and related water activities carry inherent risks. By booking, you confirm that you and all participants in your group meet the physical and medical requirements for the chosen activity.
For all diving activities and PADI courses, participants must complete the PADI Diver Medical Questionnaire before the booking can be confirmed. This form is provided during the booking process.
If you answer yes to any critical health questions, you may be required to provide a medical certificate from a licensed physician before participating. Our instructors reserve the right to refuse participation on safety grounds.
Minimum age requirements: Snorkeling — 6 years (children under 12 must be accompanied by a parent or guardian). Whale watching — recommended 5 and above. Kayak — 6 years when sharing with an adult. Bubblemaker — 8 years. PADI courses — 15 years.
4. Weather and Operator Cancellations
Mirissa Collective reserves the right to cancel or reschedule any activity due to weather conditions, sea conditions, or circumstances beyond our reasonable control. In the event of an operator cancellation:
- You will be notified as soon as possible via email.
- You will receive a full refund or the option to reschedule at no additional cost.
- No partial refunds are given for activities cancelled partway through due to changing conditions; a case-by-case assessment will be made.
5. Customer Cancellations
Please refer to our Cancellation Policy for full details. In summary:
Standard activities:
- More than 72 hours before: Full refund
- 48–72 hours before: 50% refund
- 24–48 hours before: 25% refund
- Less than 24 hours before: No refund
- No-show: No refund
PADI courses:
- More than 7 days before: Full refund including deposit
- 3–7 days before: Deposit forfeited
- Less than 3 days before: No refund
Documented illness, injury, or accident: Full refund upon submission of appropriate documentation.
All refunds are processed via PayHere to the original payment method. We do not issue vouchers.
6. Rescheduling
You may request to reschedule your booking by clicking the "Reschedule my booking" link in your confirmation email. Reschedule requests are subject to availability and must be submitted as early as possible. We will do our best to accommodate your preferred new date.
7. PADI Courses — Additional Terms
PADI courses (Open Water Diver, Advanced Open Water Diver, Scuba Diver) span multiple days. If you complete Day 1 but do not attend subsequent days without prior notice, no refund will be issued.
If you need to pause your course, you may resume within 90 days of your original start date for an administration fee of $25. After 90 days, the booking is considered complete and no resumption is possible.
PADI e-learning must be completed before Day 1. Reminders will be sent 5 days and 2 days before your course begins.
8. Liability
Mirissa Collective takes all reasonable precautions to ensure the safety of participants. However, water-based activities involve inherent risk. By booking, you acknowledge this risk and agree that Mirissa Collective is not liable for personal injury, loss, or damage arising from participation in activities, except where caused by our proven negligence.
We strongly recommend that all participants obtain appropriate travel and dive insurance before their trip. We recommend DAN — Divers Alert Network — for comprehensive dive insurance coverage: https://www.daneurope.org/en/diving-insurance
9. Privacy
We handle your personal data in accordance with our Privacy Policy. By booking, you consent to the collection and use of your data as described therein.
10. Governing Law
These Terms & Conditions are governed by the laws of Sri Lanka. Any disputes will be subject to the jurisdiction of the courts of Sri Lanka.
11. Changes to These Terms
We reserve the right to update these Terms & Conditions at any time. The version published on our website at the time of your booking applies to your booking.
